Palm Springs, CA – In a lawsuit involving 61 single-family homes in Palm Springs, attorneys from ACTS LAW obtained a $15,250,000 settlement which works out to roughly $250,000 per home. Homeowners represented by ACTS LAW were thrilled with the outcome which will allow them to repair their homes.
In this development, 88 homes in a gated community suffered damage, and ACTS LAW represented 61 of those homeowners.
These defective homes were uniquely special, including the use of defective multi-sliding doors and windows, significant stucco cracks throughout, improper slope on roofs resulting in ponding of water those roofs, just to name a few of the issues.
ACTS LAW initiated SB800 pre-litigation proceedings in late September 2023 and fought hard to obtain a very timely settlement. Had the developer not accepted the firm’s final demand, the team was fully prepared to arbitrate.
“This marks our third successful case against this particular developer in the Palm Springs area,” said ACTS LAW partner Terry Bailey. “It’s safe to say this and many other developers are not fans of our firm because we represent homeowners saddled with poorly made houses. And more than that, we win!”
The team of attorneys on this case includes Mr. Bailey as well as attorneys Brianna Franco, John Ramey, David Bederman, and Miriam Kohansedgh.
When you purchase a home, you expect to acquire a well-built, defect-free structure that will offer shelter and protection for a long time. Unfortunately, construction defects that may not be immediately obvious can cause long-term damage and compromise the safety of your home, costing thousands of dollars to repair. If you or someone you know is living in a home with construction defects, the construction defect lawyers at ACTS LAW offer legal counsel regarding property damage claims and are not afraid to take on complicated cases.
