ACTS LAW partner Boris Treyzon was recently featured in the Daily Journal discussing the proceedings of a wildfire insurance lawsuit against Liberty Insurance Corp.
Superior Court Judge Barbara M. Scheper refused to pause a breach of contract case against the insurance company and ruled that the company’s request to the plaintiff for examination under oath does not warrant a stay of court proceedings. The company initially wanted to reconsider the insured/plaintiff’s damage claim.
Kristine Halajyan sued the insurance company after it denied coverage in connection to a wildfire that took place in November 2020 for a claim of smoke and soot damage to her home.
Boris represented Halajyan and discussed the clear decision made by the Los Angeles County Judge. He explained that the judge was clear in deciding that any investigation of the claim should have been made while the claim was open and not after it had been denied.
The case Halajyan v. Liberty Insurance Corporation, 22STCV04504 (L.A. Sup. Ct., filed Feb. 4, 2022) is now scheduled to go to trial in October 2023.
